• WSCUC President Studley Begins Service on Negotiated Rulemaking Committee

The US Department of Education’s Negotiated Rulemaking Institutional and Programmatic Eligibility Committee began meeting today, with WSCUC President Studley serving on the committee.

“I’m celebrating my fourth anniversary this week as CEO of WSCUC by starting service as a negotiator on significant issues,” said President Studley. “Ever since helping launch the Department of Education’s negotiated rulemaking process in the early ‘90s, I’ve been intrigued by this method for informing and crafting policy.”

The committee will meet virtually this week, the week of February 14 and the week of March 14, and the public will be able to view the sessions.

Issues the committee will address are:

  • 90/10 under 34 CFR 668.28;
  • Ability to benefit under 34 CFR 668.156;
  • Certification procedures for participation in title IV, HEA programs under 34 CFR 668.13;
  • Change of ownership and change in control of institutions of higher education under 34 CFR 600.31;
  • Financial responsibility for participating institutions of higher education under 34 CFR 668.15 and 34 CFR part 668, subpart L, such as events that indicate heightened financial risk;
  • Gainful employment (formerly located in 34 CFR part 668, subpart Q); and
  • Standards of administrative capability under 34 CFR 668.16.
